It's obvious that these zero-tolerance policies do not work and make no sense, it's been obvious for several years - I don't see why someone can't just change the guidelines somewhere higher up to say "these zero-tolerance policies are stupid and make no sense, maybe you shouldn't use them". Also, "horrendous censorship in Germany"? Give me a break.
