It's a Democratic Party rule as far as I'm aware, not a valid legal way. It might have been a legal determinant in the old days; I know the Romans believed it was an expression of the gods' divine will ("ship or head").

They're party bosses and local leaders, the number tossed around right now is totally innacurate, it was taken back in November, however superdelegates do not have any responsibility until it comes to the actual convention, by then many have shifted to their preferred candidate, Obama had the same problem in 2008 but he started winning over them after he started winning primaries

If this was made a popular vote matter, then it wouldn't be an issue in the first place. When you've got enough people showing up casting their votes, ties are extremely unlikely to happen. Astronomically unlikely. And it's more democratic to have votes and revotes than it is to just flip a coin and say, "Alright, X won." Again, that's a ridiculous practice-- especially for a country as large and significant as the United States. We do stupid shit all the time though, so I'm not really surprised it's still a valued ~tradition~.

Because party politics made delegates into a part of the determination process. Superdelegates are just really "special" delegates; these are people who were presidents, congressmen, governors, and party leaders. They are unpledged, meaning their support for a specific candidate has not been declared, so they're free to support whomever they want to when the time comes. Normal delegates don't have this privilege of rank/status; they must declare the candidate which they support/that they think the people they represent support, and that's that.
It's a needlessly complicated system which, again, has been purposefully constructed in such a way that it turns what could and should be a straightforward affair of the popular vote-- "he who has the majority support of the people wins"-- into a convoluted clusterfuck of party affiliations, districting, proportional representation, and ritualism.
It was a popular vote though. It was literally people physically there in person voting with themselves. It was still a tie, demanding the tie breaker.

This is all great, until you realise that a lot of people who only just convinced themselves to bother to go out and vote won't take the trouble to go and do it again, making the results massively different. We're a whiny bunch of cocks here in the UK and I know here a lot of people wouldn't bother to go to the trouble of voting again.
Also, fingers crossed for Bernie. This is going exactly as predicted, which scares me, but he can make a difference to the world. If anyone lets him get anything done.
