I think he was saying that the burglary was worth it, in the case of finding a Pedophile. He's not saying that buglers should be treated like vigilante investigators, but he's just glad that finding this guy came about from the burglary.

Only real case where it'd be forgivable is if you robbed a guys house on suspicion that he was part of a major terrorist movement, stole a bunch of important documents and handed them back to the police, finding out that the documents linked up to a major plan to kill Obama in a sniper attack while he sits in a car waving to the crowd down a road near the white house and 3 public libraries.
That would be mildly forgivable in logic, but not in a legal sense.

You're reported to the Police, but it's okay because the police weren't the ones illegally searching your house. Oh and the criminals don't get charges filed against them for breaking into your house.
All I know is that if evidence it obtained by ANYONE on someone else's property it shouldn't be counted as evidence unless: There's a warrant with reasonable suspicion or Legal Consent.
I wouldn't be surprised if the case gets thrown out. hopefully he gets a decent defense attorney. possessing child pornography shouldn't be legal, but the way they obtained the evidence seems pretty questionable. with this logic, if someone breaks into your house and finds something illegal and reports it YOU'RE in trouble because the police are going to get a warrant. had they not burglarized the house, the police would not have known about the child pornography.

Yah but if he gets away with it then people might think about things not being a crime unless you get caught. Because without the people robbing his CDs he wouldn't have been caught at that time. But it's still a crime and he should be punished for it regardless of how the evidence was attained. At the same time we need to make sure that people's rights aren't trampled with evidence being attained illegally. It's like he should go away for commiting a crime, but at the same time his rights were violated and he shouldn't be going away because of how evidence was collected.
Quite the decision to be made.

There is a large difference between stolen items (i.e. said pirating or this case in point), and child pornography.
Also, fellas, you should look up American law.
Evidence unlawfully obtained from the defendant by a private person is admissible. The exclusionary rule is designed to protect privacy rights, with the Fourth Amendment applying specifically to government officials

As long as the person who snooped wasn't acting on the government's behalf, it's fine. The CDs probably won't fly for possession evidence purely on the fact that he no longer possessed them.
