It's extremely easy to argue that by engaging in that same activity they are in fact endorsing it and waiving the possibility for prosecution. It's a flimsy argument but one that can last a good while at very least. Which is precisely why that sort of investigation is rarely admissible. It would be like breaking into somebody's house to prove they are a thief. Sure you could still win the case but you're only building evidence against yourself.

They aren't going to go fucking with everyone who does anything. The idea is to add one more thing to throw at the people who piss them off.

I doubt this with have an effect on anyone, just some people will get caught and then take news measures to keep sneaky and hidden. There are programs out there to do just that, and they are free. do what you want because we did not ask for any of this bullshit, the government has gone way way to far, not just with this but with everything. We are born into this false sense of freedom, being a citizen here means they have rights over you, we do not even own our own cars that we pay thousands for, why do you think they can crush them without your consent?

Or they don't even have to upload to find evidence.

They aren't law enforcement agencies and they shouldn't be conducting investigations while participating in the same activities they seek to punish, permission or not. Again, it's a flawed argument that can be countered, but to counter it is costly in both time and money. You gotta' convince a judge and/or jury that you aren't being a hypocrite when you hire a third party to spy on people whilst pirating things yourselves. That's more difficult than most people realize, given all the defense has to do is press the idea of hypocrisy constantly.

So you'll just need a decent proxy that hides your original IP address, and it's easy as hell to find said proxies. Finding a fast one is a whole other story.
why use a proxy when you can encrypt it? isn't it illegal for the government to unencrypt it cause its a violation of privacy?
