The Xbox One has only barely been released and its in extremely high demand. It's not as if the seller created the ad for the picture for the sake of selling a picture of the thing; it's far more likely that the seller created the ad in hopes of profiting from the desperation of a person interested in buying the XB1. Although the description might have said it was just a picture, it was still priced at the value of the actual console and was more than likely deliberately misleading.

I have a flashdrive that looks like a bare usb plug (without the plastic molding around it) with 3mm of blue plastic glued to the end of it.
It's slow as balls, but 16 gig in the shape of something I tend to forget is plugged into one of my laptops USB port is still impressive.
Poor guy. I'd be devastated if I got hyped to buy a new console to only receive a photograph of it.
This has happened before to one of my old school mates, a long ass time ago when the Xbox came out. My classmates came in one day and said his Xbox was turning up after school, it did. He got a box with an X on it. Sadly i don't remember the full outcome or even if it's true but he said he got a refund.

But the original thing doesn't exist anymore. More then that, mac is mostly used by switches to determine where to send frames and all this stuff, and can be easily changed, so cloning a mac from some shitty wireless adapter/3g modem (or whatever it is) makes no sense at all.

Pretty sure it's against the rules on eBay to sell this kind of stuff.
So what if he just assumed that it was talking about a photo as the picture, normally one wouldn't assume it would be an actual photo, so yes its a scam. Just because someone doesn't fully understand something because of being poorly worded does NOT mean it isn't a scam. The only reason this was sold was to scam people, there's nothing to doubt
Also, everyone who's saying it was a legitimate auction, you should read eBays TOS, it bans these types of sales.
