They are if they condone killing him in retaliation. It's never allright for a state (whether that's a judge, or a large group of people) to decide if an individual lives or dies. Now this is where I agree. I think it's alright for an individual to decide if another individual lives or dies. at least then the responsibility rests on your shoulders. it's just evil for some faceless machine to come up and put somebody to death. When a state puts somebody to death, everybody goes home and sleeps easy at night because nobody had to do it themselves. If you were to kill somebody who killed one of your family members, then it's something you will have to live with an interpret for yourself whether you did the right thing or not. The problem with state administered killings is that everybody who condoned them doesn't really have to think twice about what they did because everybody else is going along with it. It's pretty much a mob mentality, except people can try to justify themselves because the government did it.
I forgot to mention, I don't agree with torture or all that crap. just the fact that it's an individual killing a individual, instead of a state killing an individual.

Yea I do think he deserves the same rights as a human. He still shits, sleeps, cries, bleeds, and has remorse like a human. He was granted equal habeas corpus for his trial. He should still be granted his rights as a human being.
And if he isn't capable of feeling remorse or the like, he would've been tried as a sociopath. He then would've been excluded from the death penalty.
I don't really care what happens to the especially sadistic variety of murderers, but I think it's much more economical to put them into some sort of labor program.
