I don't think actual accidental deaths should be considered. This was not an accident however and it's really pissing me off that people don't see this and keep calling it that.

Death row inmates aren't fighting and clawing with their situation. They know that they're escaping from their torment.

I suppose whether or not this will seem fair to you depends on what you think the law is for, acclimatizing people into society or punishing them.
Frankly I don't see the point in killing people as in the end all that does is save money. And if the point of civilization is to improve people's lives I don't see why you'd kill people for being in the wrong place at the wrong time.
The only somewhat logical argument for the death penalty that I've heard is that it should be used to kill the untameable, and though that doesn't take into attrition due to false convictions and therefor I find it detestable, it doesn't apply to this situation. So really the only thing that could drive a grudge against him is the primal need for vengeance, which is understandable, but highly irrational and ill founded.
