Notch proposed something very fair - play Quake 3, Mojang picks map, Bethesda picks map, whoever gets higher frags at the end of it wins, with whatever outcome would have happened if they went with the standard courts and judges approach. The fact that lawyers and shit will not agree to it because they can't rake in millions of dollars from it proves that the American justice system does not want justice, it only wants money.

Zenimax are not trying to show off their skills, they have to protect their trademark because of how copyright law works.

It wouldn't matter if they took 10 paces, played chess, or even had a foot race, its all the same.

I think Notch is extremely mature in the sense that he accepts that if he looses the game, he gets sued. Most people wouldn't accept this. Also, how do you know what the court/lawyers think? What if they find this to be absolutely agreeable?
