If he visibly has a weapon or reaches into his coat for something, yeah, go ahead and shoot. But if he's just standing there or backing away you have absolutely no right to fire.
That sucks.
If he's homeless, that doesn't explain how he could call 911 from the bathroom.
rich bitch has a phone in every room?
Either a really intimidating homeowner or really paranoid intruder whose stupid as hell either way.
rich bitch has a phone in every room?
Yeah a 50$ phone in every room, so rich :downs:

If somebody kicks in my front door at 3AM, I'd rather protect myself, cats, wife and possessions than be all sympathetic for some low life piece of shit robber. Again, favoring criminals. And no one here is even the justice system.

Getting imprisoned for protecting your own property from lowlife scum is a sign of a fucking terrible justice system
Agree, you break into someone's house and expect mercy from them? Getting imprisoned for protecting your own property from lowlife scum is a sign of a fucking terrible justice system
Yes it is. I'll shoot to severely injure if somebody breaks in. I have a laser pointer mounted to my 45 that I sleep next to, and I'm a fucking great shot. I'll shoot out both his kneecaps before he can get near me or my wife.
Getting imprisoned for protecting your own property from lowlife scum is a sign of a fucking terrible justice system
No, it's the sign of a justice system that works. Killing somebody who shows no sign of being a threat, no matter the situation, is not noble nor should it ever be excused.

Killing somebody who shows no sign of being a threat, no matter the situation, is not noble nor should it ever be excused.
Someone enters my house by force, that's a sign of a threat.
Someone enters my house by force, that's a sign of a threat.
A threat to what? Your window, your door? Under your logic, you would be justified in shooting somebody dead if they kicked open your door, stepped in, and just stood there for an hour.
I'm a bad shot, I'd just spray and pray on him. Someone enters my house by force, that's a sign of a threat.
What sort of living situation are you in? If you're in an apartment like me, don't do that. Anything larger than a 22 will go through walls, unless the place was built right...with concrete firewalls in between units. I don't have those in my building, so I need to depend on being a good shot... Or I could just get frangable rounds and just spray. [editline]8th March 2011[/editline]
A threat to what? Your window, your door?
You're kidding....right? If somebody enters at 3AM... they are a threat to everything in the home, alive and inanimate.
Why do you people WANT to shoot someone breaking into your house. I wouldn't do it unless I HAD to. You guys are too "Shoot first and ask questions later etc." type.
The only firearm I have access to is a glock 19 9x19mm And I live in a private house, so even if something goes through wall(which it shouldn't because they're made out of thick wood) it won't hit anyone else [editline]8th March 2011[/editline]
Why do you people WANT to shoot someone breaking into your house. Criminals are unpredictable. Better safe than sorry.

(assuming you have siding) [editline]8th March 2011[/editline]
Why do you people WANT to shoot someone breaking into your house. I wouldn't do it unless I HAD to. That indicates to the jury that you were not shooting to defend yourself (to eliminate the threat and kill the person) and were shooting simply to hurt and incapacitate the other person.

If I am trying to incapacitate the person, rather than end their life, a jury of my peers would look upon that better, as would his attorney.
Example case? If I am trying to incapacitate the person, rather than end their life, a jury of my peers would look upon that better, as would his attorney.
No they wouldn't his attorney would say that you were in no real danger and just torturing him because you had enough time to kneecap the guy
No they wouldn't his attorney would say that you were in no real danger and just torturing him because you had enough time to kneecap the guy
Or I leveled him before he had the time to do any damage to me.
No they wouldn't his attorney would say that you were in no real danger and just torturing him because you had enough time to kneecap the guy
Wait wait, are you telling that injuring will bring me more shit than killing him? Whoa if true, that sounds very fucked up.
Wait wait, are you telling that injuring will bring me more shit than killing him? Whoa if true, that sounds very fucked up.
It's not true, he's talking out his ass.
If they kicked open my door they would have 10 rounds of 7.62x39mm in their chest before their foot could even touch my floor
AK or SKS?
If they kicked open my door they would have 10 rounds of 7.62x39mm in their chest before their foot could even touch my floor
sounds like magic, do you happen to just sit infront of every door in the house with a charged firearm ready to shoot anybody who kicks your door in?
If they kicked open my door they would have 10 rounds of 7.62x39mm in their chest before their foot could even touch my floor
Yes, and you would go to prison for voluntary manslaughter.
http://en.wikipedia.org/wiki/Castle_doctrine
I don't think you know what the castle doctrine is. The duty to retreat does not exist in America.
I don't think you know what the castle doctrine is. The duty to retreat does not exist in America.
I beg to differ. http://en.wikipedia.org/wiki/Duty_to_retreat#American_law
I beg to differ. http://en.wikipedia.org/wiki/Duty_to_retreat#American_law
nvm then.
Exactly what I already said. The scary thing is, nowhere says anything about the amount of time you have to give them to run away...3 seconds, 45 seconds, what? Prosecutors can and will tear that apart.
