Yes. There'd be no way to apply a civil law suit (slander) as there has been no economic loss as a result of the baseless claims.

UK civil law, like US civil law, allows for general damages. Emotional trauma falls under that category.
If they haven't suffered sufficient emotional trauma to win a civil case, then they should definitely NEVER win a legal case.

To get any sort of damages, you have to prove a wrong. If it be negligence, libel, slander or any other civil wrong. There's no civil wrong for "emotional trauma". It only comes into play in determining the amount of damages to be awarded, otherwise, it has no purpose (of which general damages are only one type of damages).

You're getting a little confused. The government is part of the legislature, and the courts, who are in question in this decision, are the judiciary. They are completely separate, thanks to the separation of powers. Just because the government creates legislation which may criminally punish someone for hateful stuff, doesn't mean the government gets to decide what is hateful. Most likely a selection of their peers would.

I have no idea about the US, but I know a fair amount about Australia (and most likely the UK, due to very similar legal systems) - a civil case would most likely not be heard on an issue like this.
