You cheat with the Taliban and next time they capture one of our guys, they execute him on the spot. The Taliban isn't our friend at all, but we should build trust in them if we want diplomacy to work.

Once again, I still think that they should not be trusted, but if we can work to bring our guy home then lets do it.

The upholding factor of a terrorist group is support. They are not a legitimate government which collects taxes and can raise massive, high tech armies just by functioning. Insurgents are an invisible enemy, often impossible to tell from normal civilians. If extreme and unethical measures are taken, it will result in a great loss for he terrorists but even greater loss for civilians. And what do you do when suddenly the people meant to protect you and drive the menace out are doing it at the expense of your life?

The U.S. is probably negotiating his release so they can give him a trial and gitmo. He could be a powerful asset in enemy hands since he's an experienced soldier, in our hands he can be a useless number in our shit prison system.
