By which rights it impedes on the most.
Murder is worse than theft, for example, because impeding someone's right to life damages the person more than impeding their right to maintain property. Rape falls between the two because while not as damaging to the person as taking their life (debatable, but therapy can help trauma - it can't help death) it is more damaging to them than taking their stuff.

It isn't about rehabilitation, it's about the fact the government simply shouldn't have the right, and that retribution is not part of the fucking legal system you barbaric ass.
