Hadn't seen a thread for this yet, so here. http://nymag.com/daily/intelligencer/2016/03/north-carolina-passes-sweeping-anti-lgbt-law.html http://www.cnn.com/2016/03/23/politics/north-carolina-gender-bathrooms-bill/ "The legislation bans transgender people from using bathrooms or locker rooms that don't match the sex on their birth certificates, and prohibits local governments from enacting contradictory anti-discrimination policies. As the Charlotte Observer notes, the state currently has no legal protections for LGBT people, which means they can be refused service by business owners, and the new law prevents municipalities from adding additional protections." "The Human Rights Campaign said that in addition to the issue of discrimination, the bill will put North Carolina school districts in violation of Title IX, which means they could lose $4.5 billion in federal funding." :hammered:
North Carolina should just make a law banning LGBT anti-anti-discrimination laws in response.
Christ these lawmakers are fucked up
look at the law more... there's parts that seem like the original focus of this wasn't general discrimination, That's just the smokescreen. The LAW BANS Increasing the minimum wage, and child labor laws to more regulation. Edit: That part also having another smokescreen is it being confusing a fuck.
Shameful
:goodjob: I expected no less from my home state, and thats sad.

NC worst state in the union 2016. Or is this 1916?
Oh lovely, North Carolina is taking us back to the era of state enforced discrimination.
looking back at it... My first thought of the child labor laws is also true. Some districts have more child labor laws than the state.
how is it legal to pass laws that ban the enaction of other laws?
It just supersedes any city ordinance automatically, not prohibits the passage of a new law at the state level. Obviously the state can (and should) pass a new law to repeal this.
Just when I thought we was going somewhere and becoming better, we had to take 20 steps back and fuck up on something that is basic human rights I hate this state i'm in.
how is it legal to pass laws that ban the enaction of other laws?
It bans lesser-authorities (cities) from enacting the laws. You can't just enact a law saying all future laws on X will be illegal— because all what it would take— is a new law repealing the law that made them illegal in the first place. Virtually; such a law would have no effect.
http://www.ncleg.net/Sessions/2015E2/Bills/House/HTML/H2v3.html
The General Assembly declares that the regulation of discriminatory practices in employment is properly an issue of general, statewide concern, such that this Article and other applicable provisions of the General Statutes supersede and preempt any ordinance, regulation, resolution, or policy adopted or imposed by a unit of local government or other political subdivision of the State that regulates or imposes any requirement upon an employer pertaining to the regulation of discriminatory practices in employment, except such regulations applicable to personnel employed by that body that are not otherwise in conflict with State law.
It doesn't just apply to trans nondiscrimination laws by the way
All of this in response to Charlotte passing its own anti-discrimination law. They are taking away the power of municipal legislatures to legislate. Fuck McCrory, and the state legislature.

(c) The provisions of this Article supersede and preempt any ordinance, regulation, resolution, or policy adopted or imposed by a unit of local government or other political subdivision of the State that regulates or imposes any requirement upon an employer pertaining to compensation of employees, such as the wage levels of employees, hours of labor, payment of earned wages, benefits, leave, or well‑being of minors in the workforce
Smart tactic, instead of passing something positive with something shitty riding on it, they pass something so controversial that nobody reports on the rest of it They don't even have to pretend they're being good for once :v:
Good old North Carolina, proudly marching forward into the 19th century.
This... isn't going to hold up in courts.
I knew the GA was really butthurt over the victory won by the trans community in Charlotte, but I didn't think they would go full retard. Kids, this is what happens when you elect total reactionaries to your state offices.
As the Charlotte Observer notes, the state currently has no legal protections for LGBT people, which means they can be refused service by business owners
Shouldn't people be able to refuse service at their own discretion?
Way to screw your schools over, North Carolina. Fuck the religious zealots who put these bullshit laws in place. [editline]24th March 2016[/editline]
Shouldn't people be able to refuse service at their own discretion?
not for shitty reasons like people being transgender
Shouldn't people be able to refuse service at their own discretion?
Not if those reasons are related to the Civil Rights Act
not for shitty reasons like people being transgender

Not if those reasons are related to the Civil Rights Act
I really don't think the reason matters.
I really don't think the reason matters.
I think it does.
Is this the general sentiment of the state or just something at a political level?
I really don't think the reason matters.
Replace 'transgender' with black, Jewish, female, disabled. Still think the reason doesn't matter?
I really don't think the reason matters.
In practice it matters a hell of a lot. There are plenty of perfectly legal ways to discriminate. You just aren't allowed to discriminate against protected classes. IE, gender, race, religion, etc. Hell, getting a loan is literally being subject to discrimination. Your credit score determines what you can get.
Gaither supergate just don't allow it just end it right now the party is over
Replace 'transgender' with black, Jewish, female, disabled. Still think the reason doesn't matter?
I wouldn't force a homophobic to do business with a homosexual just as I wouldn't force a homosexual to do business with a homophobic. By your logic I couldn't even open a female's only gym.
I wouldn't force a homophobic to do business with a homosexual just as I wouldn't force a homosexual to do business with a homophobic. By your logic I couldn't even open a female's only gym.
Why? How does that "logic" work for you there pal? What about being a man stops you from opening up a female gym? Like seriously, run this "logic" by me This is dead easy simple shit man. "You don't get to discriminate" That's it. That's all. Is that so hard for people to go by? Why should you get to discriminate? Freedom of speech? Well you're a business, you don't have freedom of speech in the exact same way and denying someone service not because they're a potentially bad client or customer, but because of your own prejudices is absolute horseshit.
