These people are so full of shit it's hilarious. I bet this corporation's biggest source of income is from lawsuits.
You could bet on it and win peanuts in addition to your bet. The odds are so good, it would be like winning $2.25 from a $2 bet.
Did garry ever state a specific reason?
A specific reason for being sued?
A specific reason for being sued?
Yeah, I just realized. Nevermind.
No they don't. RightHaven is infamous for targeting websites that do not have a registered DMCA agent meaning instead of sending a take down notice to avoid the lawsuit, they can sue you directly. Unfortunately, since the server move to the United States was recent, Garry did not register for a DMCA agent (http://www.copyright.gov/onlinesp/). [editline]4th November 2010[/editline] To designate an agent:

Interim Designation of Agent to Receive Notification of Claimed Infringement (PDF format)

The move was recent wasn't it? If FP was hosted in the UK (or anywhere else for that matter) at the time the case was filed would that make any difference?
I hope this doesn't have the potential to shutdown the US FP server.
I hope this doesn't have the potential to shutdown the US FP server.
Nothing would ever shut down Facepunch.
The funny part is that we're a forum. They're suing a discussion board. This is like suing people at a conference for reading a newspaper out loud.
I'm pretty sure they won't get anywhere with us due to the fact we are under protection of the first amendment.
im scared :ohdear:
im scared :ohdear:
don't worry, everything's gonna be alright babe
It's a shame the judge can't just throw this sort of copyright trolling out of the court. It's a waste of time.
don't worry, everything's gonna be alright babe
hold me
I was thinking about this: What is the point of the In The News subforum? To share and discuss current events in the news. Given that, § 107, Title 17 U.S.C. states that: Wouldn't that mean this were to fall under fair use anyway?
Yes, but it doesn't matter at all. The company is seeking settlements that are probably lower than attorney fees (plus time lost at court), and they're doing this to a huge amount of websites. This strategy basically guarantees them a lot of money, unless someone spends the time and effort to counter-sue.
Bring back Lankist, he'll kick their legal asses with his internet lawyer skills.
Fucking damn. I knew something would happen when the servers were moved to the US. Lets hope garry doesn't loose facepunch. HOW WILL I LIVE!!!
What the flying shite?
Bring back Lankist, he'll kick their legal asses with his internet lawyer skills.
Lankist said he didn't want to return.
Lankist said he didn't want to return.
good
Hello, I thought I made this thread.
You did but nobody likes you. :saddowns:
Technically, if the person posted an article from their site, as well as provided a source to that article, it is not copyright.
America is truly the land of the free you can do god damn anything. Sue you toe nail for falling off and then sue you mom for not picking it up. Then sue Santa since you didn't get black ops for Christmas.
Came into this topic expecting Anne De Wees Allen. Was disappoint.
Copyright is abused and needs reform.
They need to add some clauses that specifically state what is actually infringement and what isn't, because Fair Use is practically ignored.
Some woman's 12 year old daughter ran out into the road and was caught a glancing blow by my car which was thankfully travelling very slowly. The girl hurt her ankle, the mother said at the time in front of witnesses that it wasn't my fault. Later she (the mother) got injurylawyers4u or similar and tried to sue. I was outraged. My insurance company settled even though it wasn't my fault, because it was cheaper than going to court. I was so angry! Nothing I could do, so I changed insurance companies straight afterwards as it was the only way I could protest. It probably is best to pay the $2 though, my father went to court over a parking fine he thought was unfair and got fined 4 times as much as he would otherwise have paid.
wow vnl first you don't unban me and then you slaughter a 12 year old WHAT IS YOUR PROBLEM
The move was recent wasn't it? If FP was hosted in the UK (or anywhere else for that matter) at the time the case was filed would that make any difference?
If FP was hosted in the UK, it'd be an international matter, and I doubt that both governments would go that far just to settle a couple of pennies in their eyes.
Moderating getting to your head I see VeryNiceLady. Just because you can ban someone on a forum gives you no right to speed down the street at speeds in excess of 100km/h and aim for young children. I wouldn't be surprised if you had the mother under the wheel of your tire and threatened to pop her skull if she protested. Moderating destroys lives.
You're acting weird for an 08'er
Nothing will come of this, I'm sure.
