He's in the United Kingdom, not the US. I'm not 100% sure, but the DMCA is a US law, so technically he doesn't need to follow it, but at the same time, we're hosted by Amazon EC2 East Coast.
I'm guessing he'll settle for some low amount of cash, if it even makes it to court. This is where safe harbor should work, because a user posted it.
