That's the thing. They rely on settlements, as going to court is almost always going to fail - as shown by what happened before. Considering they had a ruling not in their favor against a similar type of website, I doubt they'd try and take it to court again.

They never went to court it was either settled or dismissed. What you're referring to was a successful motion of dismissal. Which means they WONT be going to court for that particular case.

I did misread that, but even a previous dismissal against this company for a similar case can be used to help the dismissal of this claim.

Unfortunately there is no law against taking people to court, as long as they have something to argue (which in this case they do, however slim).
I dunno for sure but the company (or more precisely its lawyers) COULD possibly be banned from practising law but I do not think that would help.
