EA pulls A Capcom: New Video Shows Mass Effect 3 Day-One DLC Already On Disc
Technically if it's on the disk then you can go and unlock it without paying for it, you bought the disk so are entitled to anything on it in my opinion.
Except that you don't own the game itself, you own a license to play it. That license says that you are not entitled to that DLC unless you pay for it.
Also nothing Capcom did as the first ones ever in the industry.
As I mentioned before, Namco/Bandai did that with Beautiful Katamari on the 360, where you only bought 1kb files to unlock new Stages,
the last Mortal Kombat (which was released long before MvC3 or SXT) had fighters on the disc that you where supposed to unlock with real money.

http://www.qj.net/ps3/games/report-mortal-kombat-ps3-has-on-disc-dlc-chat-filter.html
And not many seemed to care back then. (and Katamari was 2007! And Namco didn't stop there, they continued this shit trough Ridge Racer and Ace Combat)
But now since Capcom did that with 2 Games (MvC3 and Street Fighter X Tekken) everyone devilizes Capcom and completely ignoring Namco/Bandai, Ubisoft, EA, Team Bondi, Microsoft, Codemasters and many others.
Which I really can't get in my head.
Sure, it was a HUUUUUGE dickmove and that doesn't make me preorder games from Capcom or buy them on the release date... but guys... cut them a fucking break already!
Your first post was:
Don't know why you called this "pulling a Capcom"
So technically "pulling a capcom" in relation to Capcoms latest decision for Street Fighter X Tekken to bring DLC as locked on-disc-content is correct. Your further informations are correct but irrelevant to the title of this thread.
Except that you don't own the game itself, you own a license to play it. That license says that you are not entitled to that DLC unless you pay for it.
I don't care what the license says.
[editline]11th March 2012[/editline]
EA has made it pretty clear that they still own the game, it's a privilege that can be taken away at any time.
Like the guy that got banned on the forums and was then unable to play The Old Republic, he asked why he couldn't and Stanley Woo (one of the main moderators for Bioware) said it was, "an incentive to behave yourself on the forums." Oddly enough, when the guy gave the story to internet news sites and they began to investigate it, EA immediately fixed the "issue" and blamed it on "an unforeseen glitch."
Sure they can revoke your key, but you still paid for the game and the law is most certainly on your side.
I don't care what the license says.
I never thought people were this open about their gamer entitlement.
Except that you don't own the game itself, you own a license to play it. That license says that you are not entitled to that DLC unless you pay for it.
By license you mean EULA? Because you can't sign a license by clicking "I Agree".
And EULAS do not hold in court
Sure they can revoke your key, but you still paid for the game and the law is most certainly on your side.
... No, that's not how it works.
When you buy a game, there's an agreement tied to it that has a few guidelines. One of which is almost always "we can take away your ability to play the game at any time for any reason we want."
Valve could easily, and legally, take away every single one of your Steam games right now and forbid you from using their services. Why? You clicked "I agree." Simple as that.
By license you mean EULA? Because you can't sign a license by clicking "I Agree".

Finally someone with a bit of sense. Maybe the US courts bend over to large corporations, but it's not like that everywhere.

And you could take them to court, because they are breaking the law (at least in the UK, things like EULAs mean fuck all.)
And if they took them away, I would still have the files. Unless they want to delete them from my hard drive which is also a breach of privacy.
I don't see how this day one dlc is making people not even buy the game. I played the first game for like 3 hours but couldn't get into it, never played the second one. But I played the demo for this one and thought wow this game isn't that bad, thought about pre ordering it, news released about this day one dlc and I though wow really, but I pre ordered the game anyway and im glad I did, the story is nice and the gameplay is fun. Although I did get the dlc cause I pre orderd the digital deluxe edition.
This is finally relevant again!
2. LICENSES
A. License Terms.
Steam and your Subscription(s) require the automatic download and installation of software and other content and updates onto your computer ("Software"). You may not use the Software for any purpose other than the permitted access to Steam and your Subscriptions. You understand that for reasons that include, without limitation, system security, stability, and multiplayer interoperability, Steam may need to automatically update, pre-load, create new versions or otherwise enhance the Software and accordingly, the system requirements to use the Software may change over time. You understand that neither this Agreement nor the terms associated with a particular Subscription entitles you to future updates, new versions or other enhancements of the Software associated with a particular Subscription although Valve may choose to provide such updates, etc. in its sole discretion.

The Software is licensed, not sold. Your license confers no title or ownership in the Software.
You agreed to this.
You agreed to this.
EULAs still don't stand in court.
And just because something might be illegal or breaching of this EULA, doesn't mean people won't do it and not get caught anyway.
13. TERM AND TERMINATION
Either you or Valve has the right to terminate or cancel your Account or a particular Subscription at any time. You understand and agree that the cancellation of your Account or a particular Subscription is your sole right and remedy with respect to any dispute with Valve.
Here's some more, too.
What continues to baffle me, is that these companies must think we're fucking idiots and that we won't ever find out... when in reality these things are usually plastered everywhere within 2 fucking days. Yet they still continue to try and hoodwink their dedicated fans. It's absolute bullshit, and there's no excuse.
There is NO excuse.

Yes, I have read the SSA & Steam EULA, you don't have to quote it to prove a point. The point is that anyone who creates an account under the age of 18 cannot legally agree to this anyway. Which pretty much means 99% of Steam users have both that, and the fact that no respectable court would even acknowledge the EULA to their advantage.
And lets be realistic, who would take it on the chin if they had their games taken away from them anyway? I know I wouldn't.
Capcom, you say?

So that means I can break the SSA and EULA without any sort of backlash because I'm under 18?

lol EA apologist
So that means I can break the SSA and EULA without any sort of backlash because I'm under 18?
Without any legal backlash yes, they can still revoke licenses (and if they do, you can sue them for it, even if you were in the wrong they're still taking away something you paid for WITHOUT REFUND which is illegal.)
WEEEEO WEEEEO WEEEEO hear that it's the sound of the Autism Defence League coming to defend EA and bioware WEEEEO WEEEO WEEEO

actually, should sound more like this.

Hey guys, apparently publishers can write laws which means we forfeit our consumer rights!

Of course they did that, but they did not invent first-day DLC nor where they the first ones adapting it. And that is what annoys me the most,
because in EVERY discussion involving DLC, Capcom gets mentioned in a negative way.
So the title is "EA pulls A Capcom" how does this even makes sence? Capcom started with their bullshit DLC and also day-one DLC long after other companies (which includes EA)
So shouldn't the title be then "EA does what they do best"?
Of course not, because it's cool nowadays to hate capcom so hop on the bandwaggon and
devilize them at every possible time just to show the world, that I once have heard something about Capcom and DLC in a sentence.
"Am I involved in all this? Am I even buying Street Fighter X Tekken? No! But hey, Capcom pisses me off, because it pisses everyone else off!" herp derp

Licenses mean shit, I will do whatever I please with something I paid for.
lol because you have no idea whats going on story wise.
lol, im gonna play the 1st and 2nd so I can get the whole story. But I still bought the game, someone who is not even a fan of the game series and I saw the dlc and said, whatever, looks like a good game Im gonna buy it. If fans are not going to buy the game because of this dlc than your just being ignorant and silly.

The game is fine and the series are great. It is the marketing strategy that is simply ruthless and totally fucking over customers.
ha
The game is like a great drink, except at the bottom of the glass there's a worm so you puke it all out.
Epic did exactly the same with Gears 3, about 4 maps and a 'game-mode' were on the disk from launch :v:
Be it they did release it for free later, but the game-mode is still charged for I think.
[editline]11th March 2012[/editline]
Oh yeah and the unlockable characters.
Here's the thing, regardless of what any one of us think about 'Day 1 DLC', it's not up to us, it's up to devs to decide, it's their game, they want to make money and by golly they've got every right to do so, if you don't like it, don't buy the game, don't buy the DLC but most of all, don't sit around complaining over content, there isn't anything you can do but accept that this is the way things are.

DLC is fine, but if it's on the disk when you buy the game it should be free and already in the game, not something they try and get you to pay to unlock later.
