Expansion packs completely new locations, storylines and objects, dlc has horse armor. Obviously Bethesda released their stuff as DLC, and in my opinion it was DLC compared to Oblivion's expansions.

Pretty much the only thing that Bethesda specified was the amount of DLC that they'd be making: the design concepts and execution were original by obsidian. Sawyer went on at great length about the process behind them (especially the weapon pack, which didn't have a warm reception)
Bioware confirmed that they are framework files to allow for seamless integration, not the dlc itself.

Several hundred megabyte framework files that people have PROVED contain dlc and you can unlock it, so obviously Bioware are lying and it's not the first time they've done that.

Why would the sales stop the moment the dlc was proven to be on the disc?
And it's a great business strategy, especially since many many games are bought with parents' money and since there are people having this weird attitude like "omygod thanks bioware for releasing games you are so generous. And you can overprice your games as much as you want, I can't complain".
Because that's all what day 1 dlc is. It's overpricing your game in a clever way. Think about it. You make a game, you cut off a small part of it, the more appealing the better (like the fucking prothean). You sell the bigger part of the game as full game and then you sell the part that you've cut out for additionally 10$. It's very clever and people who, well don't have enough brain to process it, don't see it as overpricing at all. And yeah you don't have to buy it. You don't have to buy anything, including the fucking game.

DLC should follow two criteria if you want people to accept you:
- Be [b]conceived[/b] after release, not before
- Be priced according to the amount of effort put into it
A reskin of a vanilla gun should only be one dollar MAYBE. An entire game area should be around ten. Anything conceived before release, regardless of effort or what stage of development it was in on release day, should be free, whether included in the base game via patch or available as free DLC is of no concern.
