Then why doesnt everyone get probation? why do some go to jail and others prison for the same crime? Why are some sentenced to death while others live in a cement square for the rest of their life for the same crime? Its the discretionary policing system. Prosecutors recommend punishments, but in a bench trial the judge has full authority. This judge is a federal one so really he has a lot of room to play with for what he does. In this case he sentenced that man to 6 months jail and the writings. He's still doing hard time, but has conditions along with it.
Lots of reasons. Maybe the circumstances of the crime were different. My point is that while sentences obviously vary, if you're not willing to apply it every time the circumstance is the same, it's an unjust sentence. You can't say it's just for this kid to go to prison for 8 years if you don't think every kid making a sarcastic threat should also go to prison for 8 years. If this judge isn't going to consider the veracity of this "threat" he needs to stop being a judge.
The kid is still pretty stupid for posting that'd he'd shoot up a school in a country where that happens often.
Agreed, but that's no excuse for attempting to utterly wreck his life. I believe a slap on the wrist and a lecture would be sufficient.
Gotta have more human cattle for the private prison industry - Its CEOs aren't rich enough this year.
Wasn't this in response to somebody asking if he was going to 'shoot up their school' or something anyway? He didn't just randomly spout this out for no reason, somebody was trash-talking him and he responded I think. I think I read that in an earlier thread about this, so it might not be true.
