I'm going to narrow this down to law suits from Nintendo for using almost identicle assets or because he essentially stole the entire concept from another game entirely and did very little to actually hide that fact.

I like to pretend that my math teacher did this. A few weeks before the game went huge she was talking to us about it in class. She didn't teach that day and just let us play it. By the end of that week the entire school was doing it and we had commandeered a board in that room for high scores.
Fast forward and it's huge and everyone's playing it and all of us that were in the class that day were already bored of it.

they look very similar and have the same core mechanic but the gameplay is about as different as you can get in terms of pacing and difficulty
yeh that's pretty dodgy but, like it has been said earlier in the thread, this guy made flappy bird as part of a hobby, he never marketed, and he never intended it to blow up like it has - hence why he is doing what is perhaps the morally correct thing to do; pulling the game
the guy who made pioupiou has openly said he's not pursuing a lawsuit because, guess what? he doesn't have a case
just like nintendo doesn't have a case because green pipes are not something you can sue people for

I've seen people play it, it reminds me of flying in Super Mario World, just with a bird instead of a caped mario.
Got to 125 and it's lame as shit now. Takes over a whole minute just to get back up to 100~ and then my hands start sweating and I lose.
I don't know why everyone calls Flappy Bird a helicopter clone. I mean, the only similar thing is that you fly and dodge stuff.

it's a very simple and broad criteria. regardless of whether we think the game is good or not, flappy birds is paced in such a way that it plays completely differently to the helicopter game
people are boiling it down to the point where we could say "woah arma uses the left click to shoot at enemies? wow what a cod clone" and make just as valid a point

regardless, the core mechanic isn't what makes flappy bird interesting. yeh the controls are the same and the premise is the same but, like i've already said, flappy bird's pacing and actual control response is so different to helicopter game that they feel totally different to play

This, there's so many other better android games out there, hell they even have nes and snes emulators.
It's weird how the games that reach the top of the app store are complete copies of typical flash and even arcade games. I mean look at Angry Birds. Helicopter games have been around for more than twenty years and there's nothing new about this one. Yeah they're successful but they shouldn't be known as great game designers.

I'd say the developer is overwhelmed by the sudden spike in attention and simply doesn't know how to cope with it. I wouldn't be surprised if he brings it back after he's had time to rest and figure out how to handle the game's popularity and revenue.
As for all the "GAME ART LOOKS LIKE SMB" talk: "Temp Art" is a thing that exists in game development, where sprites and assets from other games are used as placeholders to build the game mechanics, while the actual game art is created. It's a perfectly normal thing in game development.
Even then, it's clear that the art hasn't been directly ripped from the Mario game. Yes, the art is obviously [I]inspired[/I] by it (possibly because of the use of temp art - I'm just speculating), but the final game on sale doesn't pretend to pass itself off as a Nintendo game, nor does the finished product feature artwork ripped directly from Nintendo. It is technically legal.

Thank God, that is literally the biggest waste of time ever. My friend keeps bitching about how stupid and frustrating it is, yet the next time I see him, he has his face stuck in his phone again, still playing it.
