Where and how, I don't know, the openxcom community (or the X-COM megathread in Games General) would be a much better resource.

I couldn't find anything about it on forums though. Oh well, maybe I'll buy it on Steam soon.
So how is this legal? Did they get permission from everyone holding the IP's? Or did their patents expire?

The most that'll happen is they'll get a notice to take down the file because it's being updated, sold, or whatever, and they'll comply and move on.

"The 2010 Edition features improved graphics and native support for higher resolutions (640x400, 960x600 and 1280x800). Standard, oldschool graphics are also available."
So are these full games? Or are most of them demos?
