Well, we're both right. Every single court case about this has unanimously decided to overturn proposition 8 on a constitutional basis (Prop. 8 violates the Due Process and Equal Protection clauses), but the religious force that created it in the first place keeps appealing it. Since the circuit court has already voted on it, this case actually isn't that far from the SCOTUS.

Not really - most countries of the world don't really have many laws regarding gay marriage, either - only 10 countries so far have made it law.
Personally I think discrimination protection towards marital status are a bigger, underlying issue - but hopefully a sweeping show of support for same sex marriage will clear that up.
