...who says we have mandatory drug tests? That's up to the company, not all do it, and they're not even "mandatory" in the sense that it's an employers right to hire drug-free citizens. You can opt out of the job if you want to opt out of the drug test.

Of course it's up to the company. It doesn't change how stupid it is to be fired over having non-psychoactive THC in your blood. It's mandatory if it's either pass the piss test or lose your job. Of course you can just opt out of your job, but that's irrelevant to my point. It's cut and dry discrimination. Do I need to repeat the obvious? Weed stays in your system for weeks, even if it's stone cold obvious that you're stone cold sober.

Also, the parliamentary system. Technically, nobody voted for Harper at all; they voted for a Member of Parliament in their electoral district. Each Member of Parliament that gets elected earns a seat for their party. The leader of the party with the most seats then gets to be Prime Minister.
Harper won a majority of seats this time, while still only getting 39.6% of the popular vote. (This is supposed to be a good thing so that low-population areas are fairly represented... but the voting system is still so stupid.)

How is that a violation of our rights? I don't blame an employer for wanting to ensure their employees aren't going to be high on the job. If someone fucks up when they're blazed as shit, it's a lawsuit waiting to happen. They're covering their own backs and it makes perfect sense. If someone can't lay off the bowls for 3 weeks to pass a test, imo they have bigger problems to worry about.

Because any drug test other than a breathalyzer indicates if you've used drugs at some point in the last month or so. Canada is not the United States - to fire someone you have to demonstrate that they are unable to fulfill a "bona fide occupational requirement".
Current sobriety is absolutely one of those requirements, sobriety 3 weeks ago isn't.
Furthermore, during hiring you cannot require the disclosure of disabilities beyond those that prevent you from fulfilling a bona fide occupational requirement. Drug addiction is a disability, and pre-employment drug testing would reveal if someone has this disability. Doing this is akin to asking if your employee is gay or used to suffer from depression. It's discriminatory and illegal.
The only allowable drug tests are ones that test for current sobriety, or traditional drug testing with reasonable cause to believe that the employee is using drugs on the job - such as finding drugs in their possession at work or after an accident.
