I get nervous if anyone I do not know that is wearing gang affiliated clothing walks towards me, which just seems to be black people more often than white people

Such as, an employee can be terminated for saying "I hate black people" because this statement can be disruptive to the environment the organization is trying to create. Most speech codes tend to limit speech based on equality codes, as to create an equal work environment, at the cost of free speech. However, you mentioned why they can't discriminate on race, religion, etc; because, these cannot be prevented and in most cases, are not disruptive, but an employee can be terminated if they used their personal attributes and alignments in a disruptive manner. Speech codes also can apply to what actions are performed on private property i.e. it is illegal to protest on private property. Speech codes are controversial , but for the most part, do their job to maintain stability in the organization, after all, words can speak louder than actions.
