1. The woman was about to use deadly physical force.
2. He could not have retreated instead.
For number one we really do need the footage of the store cameras, there just isn't a possible way to determine if the woman was attempting to pull out a knife.
For the second point though, lets say that she was attempting to pull out a knife, if he retreated when he could have that woman could have harmed over employees without big metal rods.
It really just comes down to the footage of the cameras in the store.
1. He probably reasonably believed the women were going to use deadly force as they jumped the counter with intent to hurt.
2. The restaurant could be considered his dwelling as he works there for many hours per day, and was obviously not the initial aggressor. Or, If he retreated he would have put his fellow employees at risk as the women could have used said objects to attack other employees.
1. That will be up to his lawyers to prove.
2. What a dwelling is is well enshrined in law, this isn't one.
"Dwelling" means a building which is usually occupied by a person lodging therein at night.

I'm saying that they would easily have been subdued because of how many staff members there were so they were not much of a threat.
How many of the employees could they have injured before they were subdued? Doesn't take much to stab someone if they had a knife.

What if he works night shifts on a daily basis?

If they had a knife and intended to use it, why was the knife not out? And why did they not appear to be reaching for one? You can't argue this.

Yes I can. If he had let them get back up, they could have gone for a knife.
That blond woman represents the worst America has to offer in terms of females.
Yes I can. If he had let them get back up, they could have gone for a knife.
And maybe they hand a hand grenade in their pocket.
McIntosh
Heh.
Bitches deserved it though
What if he works night shifts?
You don't lodge at work.
And maybe they hand a hand grenade in their pocket.
Yes, maybe he had reason to believe.
And maybe they hand a hand grenade in their pocket.
Seriously? Why do you think it's so unbelievable that they wouldn't have tried to injure the employees if they were allowed to get back up?
And maybe they hand a hand grenade in their pocket.
They were in an area with plenty of potential weapons. Whether or not they had any in their pockets is irrelevant.

I think it's unbelievable that they would have attempted force against the employees if they got back up, considering EVERYONE IN THAT KITCHEN was surrounding them.
They were subdued at that point. It was done, and if the guy left it at that I'd be on his side 100%
I think it's unbelievable that they would have attempted force against the employees if they got back up, considering EVERYONE IN THAT KITCHEN was surrounding them.
Then they wouldn't have slapped the employee in the face and jumped the counter if that was the case.

They tried to get back up. He was making sure that they couldn't do any more damage. What would you have done in his position?
New York (CNN) -- A cashier at a New York fast food restaurant has been charged with felony assault for beating two unruly customers with a metal object during an argument.
The man remain hospitalized in serious condition, police said.
The incident occurred at a McDonald's on West 3rd Street about 12:30 a.m. Wednesday.
The two 24-year-old men entered the store, placed their order and then began arguing with the cashier, 31-year-old Rachel McIntosh, police said.
CNN affiliate WCBS said the altercation began when the cashier questioned a $50 bill the men gave her. They responded by hurling obscenities at her.
A cell phone video shows how the situation quickly escalated.
One of the men curses at the cashier, then reaches over and slaps her face.
The man then climbs over the counter, sending the cashier running toward the kitchen area. The other man walks around to join his friend.
The cashier then suddenly reappears with what police described as a metal object and repeatedly hits the men.
Restaurant patrons scream for her to stop, while other employees try to intervene.
The video, one minute and 10 seconds long, shows the cashier hitting the men 10 times as they lay on the floor.
"Stop! Stop!" one woman screams. "Stop it! Call the cops!"
The cashier would pause and begin again every time the men tried to get up.
The two men suffered lacerations to their head and face and were taken to a hospital, police said. CNN affiliates said one had a fractured skull and a broken arm; the other had a deep laceration
Authorities identified them as Denis Darbeau and Rafael Edwards, and charged them with menacing, criminal trespass and disorderly conduct.
The franchise owner Carmen Paulino told CNN affiliate WABC that the cashier no longer works at the restaurant.
"I am extremely disturbed by the events captured on tape and am concerned for those injured," Paulino said. "The actions of this individual are unacceptale and not characteristic of my employees."
McDonald's too released a statement, saying the franchisee is cooperating with the investigation.
"The violence in this video is alarming and reprehensible," it said.
Those men had it coming to them.

Got everyone else in the kitchen to keep the situation secure while I called the cops

I'm parodying his image.
Why is everyone defending this guy so much? Yes what he did was amusing to watch and pretty badass and yes the two women got what was coming to them, but you all seem to be forgetting that there are much better ways to prevent someone from getting up than beating them repeatedly with a metal rod.
Judging from the video almost everyone else, including co-workers thought that he was taking it too far.
Those bitches got what was coming to them. maybe they will think twice before fucking with some one like that again. At least for a while! I worked for a fast food joint and there were times I wanted to do this.

Abusive customers get what they deserve. If they had slapped him and walked off and he chased them with a metal rod and beat the shit out of them, I'd agree with Zeke in saying he went too far.
However, they invaded the employee's space in a threatening manner, and he dealt with the situation reasonably - he didn't use a meat cleaver or chip pan fat to subdue them.

see i agree he did take it too far, they got what was coming to them but in retrospect if he had just maybe warned them off with it rather than beat them senseless or maybe just hit them once as a warning to fuck off.

Don't forget, he had left the area as the women were jumping over. He specifically came back with the pole.

Because you somehow disagree with him? I do not follow your argument, which somehow provoked you to make a parody of his image.
He went full retard the moment he decided to beat them while they were down. He deserves to be charged for that.

As he realized his co-workers were in danger. Heroic if you ask me.

They were trying to get back up after he warned them with hand signals and I believe I saw him yelling at them not to move in the video.

I don't disagree with him that a kitchen is dangerous but his condescending diagram with big letters and arrows was retarded.

They were following him. Maybe he should have waited for them to enter the kitchen?
