It's as regulated a market as you can possibly get. Without patents there is no/little incentive for small companies/individuals to innovate. The system doesn't work because he did it before (and a similar challenger didn't emerge) and he would have/will do it again (In the unlikely event that he does get challenged he will still make a killing in the mean time and people will still get screwed over by his fucked up practices). Him doing it and getting away with it will cause other ass hats to wriggle out of the wood work to racket them some life saving drugs.

What I was criticising in Sableye's post was him pointing fingers at the free market bogeyman, which is a misinformed opinion. Criticism should be directed at the right places or nothing useful will be done.

I'm not saying it happened here, but what about if a company simply can't afford to keep producing said drug unless they significantly raise the price?

Its a good thing they can jack the prices up. Think about it - they bring in more moolah, they invest more into R&D so they can come up with more overpriced drugs and make even more dosh. In the end every disease gets cured and the world is saved. Sure some people along the way might not be able to afford it and die, but sometimes sacrifices have to be made in order to have humanity advance forward.
