This looks like either a precaution for their newer stuff or legal found out about bug bounties. As far as I know, exploits on Nintendo devices have only been found and used for homebrew reasons. It gets me wondering: has there ever been an exploit used for malicious purposes yet?
As far as Nintendo is concerned, homebrew is malicious, let alone piracy.
There is actual homebrew malware for various devices (which brick your console or steal an ID so the malware author (or someone they sell it to) can use it to cheat without risk of getting their device banned).

Some people use it for cheating in online games, but its more common to use it for piracy
Sounds like I shouldn't purchase any games off the E-shop on the off-chance that it gets used for an exploit and I get screwed out of my money or banned.

They have taken games off the e-shop before for being exploitable and you have always been able to re-download them and not get banned, so.
