No, actually it's up to the Judge's discretion to determine what the Justice system is meant to do.
If the judge opts to go for sanctions (ie jail time), it must be for one or more of the following reasons (according to the legislation in that area [Victoria, Australia]):
- Retribution
- Deterence (both specific and general deterences)
- Rehabilitation
- Protection, and
- Denunciation
It's up to the Judge (and the binding legislation and previous cases) to determine what of those 5 aims the court may enforce by giving criminal sanctions.
As GunFox said, most of Austrlia's Justice Systems dish out justice through 'restorive justice'. In Victoria, the victim of a crime are allow to go in and make a 'Victim Impact Statement'. This involves telling the court how the crime has affected the family of the victim.
This is then taken into consideration if the accused is found guilty, and then the judge may issue a sanction based on 1 or more of the 5 aims of criminal sanctions.
In this case, the driver was found to be very remouseful of what they did, and the judge took this into conisderation and issued a light setence with the aim of protecting the community from a him while he was being rehibilated.

I would not necessarily say that the speeding was reckless. I live in a relatively sparsely populated area and you can do that speed just fine on narrow country roads. But here comes the twist: You use your goddamn brakes before spots where you can't properly see oncoming traffic as well as when seeing oncoming traffic. I bet he was too busy making sure he's got his amazing speed (which is really just slightly above the suggested speed on the Autobahn) on video.
