Rather than paying for all the lawsuits, raise money to pay for the surgery. Many prisons don't even provide good enough basic health care, paying for the surgery would be unfair to other inmates.

As much as I would personally use "them" to refer to a newborn, it sounds more like a "I can't really tell what this newly born living thing is, I don't know what sex it is" kind of thing, where babies are usually not seen as fully developed people, since they kind of aren't. However, calling an MTF person who is obviously presenting and thinks of themself as a woman, calling them It instead of She is easy to see as dehumanising/objectifying/whathaveyou, i.e. "what's that tranny doing here? It should just stick to drag shows"
