can basically just mean any state where you don't remember, including being so drunk that you don't remember or sometimes being passed out.

It's possible to have such a high tolerance for alcohol that you drink enough to 'black out'. You're conscious, can walk and talk, but you're still very drunk and probably won't remember most of what you said or did while in that condition. Usually people who don't have that tolerance, or aren't using a drug like coke or meth to keep them up, pass out before they reach that point. Passed out is when you're unconscious.
People who haven't done a lot of drinking might not know this.

Tolerance doesn't really matter, you just need to drink enough to not remember and drink little enough to not pass out.

I can't sleep if I'm drunk. So it's stop drinking and wind down, or keep drinking until I don't remember.

It's this type of girl that gives all other accusers of actual sexual assault a bad name. The worst part about this story isn't the Guilty until proven innocent or that the university won't open the case. It's the fact that many other girls will see this and think they can claim sexual assault on some fling they had because they refused to let them copy their notes or w/e stupid reason.

People who have low tolerance can't usually find this spot. If you have a low tolerance, you usually end up getting to the pass out phase so quickly after the blackout phase that the blackout phase may only be a couple minutes long if that.
However, with a higher tolerance, you will be in the blackout phase longer because it takes more alcohol for you to reach the pass out phase. For instance, I used to pass out when I first really started drinking. Never really had any "blackouts". However, now, I can drink myself back sober, which comes with hours of being "blacked out".
TL;DR: If you have a low tolerance, the "enough to not remember" and "enough to pass out" may be a 1 shot difference, meaning it's very easy to overshoot, whereas with a higher tolerance, it could take 8+ shots to get from "enough to not remember" to "enough to pass out". Tolerance has everything to do with if you will experience the blackout phase, or if you will go right past it to the passed out phase.
Pretty messed up they were able to kick him out on basically no evidence.
It is good that the text messages vindicate him; I expect a pretty conclusive legal victory.

You do know that you dont have due process rights at a university disciplinary hearing, right. I mean the dude wasnt even charged criminally with anything.

In the text messages she acknowledges that he is drunk. According to the Student Handbook drunk people cannot give consent. She admits in the hearing that she initiated the sexual encounter. The hearing finds that he was drunk. But then says he is at fault.
Based on what I'm seeing she would be the one charged with sexual assault considering he was drunk thus not able to give consent.
But of course, its generally held that men cannot be sexually assaulted by women.
The hearing was also lopsided since only the accuser is allowed an advocate. The defendant is only allowed a adviser.

I seriously hope that the public courts take this and investigate what truly happened there. And whats wrong with that college's dispensary practices.
