So what I get is he signed a contact which He can't be in adverts for other systems. It seems the contract is still in effect or something.

but why can't we just agree that kevin butler enjoys all video games

Kind of goes against the whole "It's about the gamers and the games they enjoy, not about swearing allegiances to a specific title or platform!" thing his character promoted. That was what really made the character great.
But seriously, they dropped him, so they should just suck it up. He seems like a really cool guy.

They're not suing for breach of contract (or such) though, they're suing over trademark infringement.
And even then, they're suing a tyre company, they wouldn't have a non-compete contract or so.
