Lawmakers didn't make voyeurism legal, they made it illegal. So you can't blame them. The COURT ruled in this case upskirt photos are not voyeurism and therefore not illegal.
So if it's anyone's 'fault' it would be the court's fault. Even then they are not saying it should be legal, they are simply pointing out that as the law now stands it isn't illegal.
I don't know who the 'someone, somewhere' you refer to is supposed to be if not lawmakers or the court. There aren't any other parties who could be considered at fault, since no one else gets to write or rule on the law.
Why would skirts exist if it was illegal to look up them.
