i think you're really overestimating the eating ability of really young children.
this law isn't for 40 year old man-children. It's for infants and toddlers.
Even things like Legos have choking hazard warnings on them because toddlers have an innate tendency to put things in their mouth, even if it's clearly not food.
but honestly, what does a plastic toy honestly add to a chocolate egg? It's just a marketing scheme. If they'd just sell the chocolate without the toy inside of it, this wouldn't even be an issue.
I don't know about some people but if I bite into a chocolate egg and find a plastic toy inside, I am not going to continue eating the plastic.

Because paper can technically be digested, these eggs are only banned on the technicality that it's non-food encased within food, paper, while not particularly good or easy, can be safely eaten, a large plastic egg, not so much. And let's be honest, with the age range these are meant to be given to, the choking is a pretty real threat.

If you're still young and dumb enough to be putting plastic in your mouth and trying to eat it, then you're too young and dumb to read as well, so those warnings don't do anything to stop the child. If you don't want your child to eat something, don't give it to them.

Why isn't a warning good enough? Would you eat a chocolate bar that said, "Warning! Contains shards of glass - extremely dangerous to health!" just like a Kinder egg says, "Warning! Contains small parts - not suitable for children under 3"

Kinder Eggs have always been banned in the US. It's never been sold here because of the FDA rule on non-food items inside food.
It's a myth that they've been banned due to children eating the toy. They've never been sold here in the first-place.
