My main rebuttal to that is Steam has always been that way, and when you pay 5 bucks for half the games on your list, it's slightly not as bad. These games you pay for the disc, so you pay full price, and it's a new system they implemented. Also how many times have you taken a pc game to gamestop? Or gone to family video to rent DotA 2? Steam works well because it does what it does on a platform that's never had to the flexibility to really have a used games / rental market. Console games are basically strictly used games and rentals, and now they're taking that away which is a huge difference. Yes the system is the same, but the implementation and context are all wrong.

Exactly and this is why I love Valve. Valve treats you as someone who's responsible enough to simply ignore the person, either through inaction or enabling ignore, whilst MS wants to baby everyone.

Yes, but this clause is probably more specifically aimed at the "Full List of Working Keys Cracked" type deal.

No, it's probably more for the non-legit ones, like Dirt 3 a year or so back.
Although in that case Valve just deactivated all copies of the game activated with those keys and didn't punish anyone.
