I'm so pissed off about the number of kids who think "He swung first its self defense" No that's not called self defense that's called a fight. The only case in which it is self defense is if you have no where to go and no other option then to match force with the assaulter. Such as you are in a corner and you can't run or you are in a room and the assaulter is in the doorway.

There IS nowhere to go when you are at the register. You have heavy equipment 2 feet behind you, to one side the drive thru, and the other side is a door going out to the lobby where the fighter is waiting. You ARE trapped, and it is self defense. Also, even if he had a place to run, it is still self defense to do it right there. You have no moral duty to run away from your attacker. You got beat up by bullies a lot, didn't you?

Well turns out that's not the way it works. As long as you have a viable option of escape or backing away from the situation its not self defense. I had to sit and listen to all the charges that could have been filed against me had the other guy pressed charges, no where in that was the option for me to plea self defense. And as a matter of fact Yes I have worked at a fast food restaurant before it sucked. But yet there was a place to go its not like you are stuck in place behind the cash register. Whilst he could have retreated, he successfully argued that he wasn't only defending himself, but was also preventing other members of staff and customers being assualted by the guy.

And he hasn't been fired.
