I've been happy with every Nintendo game I've preordered.
With the exception of Twilight Princess HD because they let that one slide with the massive FPS drops in some locations.
I'll give Nintendo themselves a pass on that one though since they let a third party do the port. Still disappointed with them for it though.

I don't think radio silence is helping anything either. It's getting too late but an apology, explanation and addessing an attempt to correct the issue(s) would've gone a long way.
Hiding in a corner is a pretty stupid and awful thing to do to your fanbase.
Just got a refund. Bought it on release day with 4 hours playtime within the first 2 days after purchasing. Used the reason "Doesn't look like the screenshots and videos."
Requested a refund at 19 hours, 10 of which were spent dealing with the game crashing and having poor performance, even with the experimental branch. The rest were spent finding out how much that was advertised was actually missing from the game.

I honestly don't even recommend touching Bethesda titles until their GOTY edition comes out, because trying to deal with mods when Bethesda is constantly patching the game is a massive pain. I'm not really a fan of the game updating, then essentially becoming unplayable for a couple of days until the script extender and mods get updated for the new update.
That, and Bethesda's titles on release are usually extremely buggy, and sometimes even get worse in later patches (Skyrim v1.2 comes to mind).
I got my refund no problem. I don't consider myself swindled simply because I didn't buy into the hype (or follow it for that matter), it was quite frankly boring. Gather shit, make shit, fly somewhere, repeat. That was the whole game.

Worst comes to worst, I'll give Hello Games a chance to pull through. The blueprint of a good game is certainly there.

Pretty much the same. I am a bit frustrated as well, perhaps there is something to explore on consumer laws that may fall into the lines of false advertisement. I would personally like to see Hello games lose their studio, and them to lose any potential in further advancement in their careers. Or they alternatively resolve the problems they have caused.
Undoubtly, the game was one of the worst releaseds I've seen.

I unfortunately doubt it. The law doesn't favor us in the US the way it does in the EU.

usually US laws only protect against scams, loosely. The FTC is undoubtly useless when it comes to consumer rights because it bites away at the heals of capitalism at its finest principal: deception.
"I have an idea! Let's make a game, and promise ridiculously crazy features, but not put them in the game. Instead, let's make it so the game is designed so that people will search for hours to find those features and, when they finally give up or realize that they're not there, they've already passed the refund time!
