The ACT passed laws which allowed gay marriage, however the Abbott Government challenged it in the High Court. Regardless of anyones opinion on the topic, the ACT did overstep its ability to legislate.

Basically, the Court said that the ACT cannot legislate for gay marriage while the Commonwealth legislation explicitly disallowed it. By stating this, it means that as soon as the Commonwealth legislation is amended, that gay marriage will be allowed in the country.

Ridiculous. Sex is black or white, just depending on whether you've got male or female genitalia, what, are we going to have numerous unnecessary categories for sex now? Sex is biological and dependent on chromosomes, external genitalia and hormone profiles.
Gender on the other hand is what should be given more fields, because gender is not black and white like sex is.

This ruling will affect absolutely nothing other than what's being put down on a piece of paper. It's funny watching people flip their shit thinking that "society is being ruined!!!" when all it does is make people feel somewhat more comfortable in society.
This is not a "feel good" law in the sense that someone's rights/privileges are being stripped in favour of a minority. It's simply just a third option in legal documents.

I can already tell by your use of the phrase "our iteration of human evolution" that I don't like you.
Here's a crash course to intersex conditions. Basically, there are several different "scales" of sex.
First of all, there's the obvious chromosomes, but guess what? People can have different chromosomes than just XX and XY. X, XYY, XXX, whatever the fuck you can think of, [I]somebody[/I] has it.
Second, there's genitals and various related parts. Short penises, long clitorises, etc. And what do you call a person with both testicular and ovarian tissue?
Finally, there's hormones. For example, androgen insensitivity syndrome can happen to genetic males (i.e. people with XY), and it causes them to develop as a female would, with zero indication otherwise beyond a genetic test. There are various other hormone-related disorders as well.
Also, about 1% of all live human births are sexually ambiguous to some degree (however, only 0.1% to 0.2% of births are ambiguous enough to receive medical attention).
I don't understand why so many people have a problem with this. Why exactly is it wrong for people who are transsexual, intersex, etc. to be allowed to indicate a more specific or appropriate sex on their legal documents? Is this suddenly an issue of conformity?
I think it's fine if some people disagree that there are other sexual identities besides male and female, and there are appropriate ways to discuss and debate this. However, expressing that everyone should be forced to identify as one of two distinctive sexes is just wrong. There are too many variables to make an argument for that.

You can say gender is not binary and be honest, but I feel odd saying sex is not a binary when every category besides male and female is just broken or malformed versions of one or the other in some way.

The amount if pure ignorance in this thread is fucking astounding. I think it's interesting that everybody's all for gays but all against the gender identity thing. Call yourself whatever you want to be called, in the end, it doesn't make any difference to me
The way I see it, physical attributes are pretty much binary; there's really not a ton of variation there, but personally I'd rather live in a society where people aren't categorized by whatever bits you happen to have dangling off your crotch. I'd rather people are recognized for who they actually are inside, and I'd rather live in a society where people are compassionate about respecting what makes their fellow human beings comfortable.

But how would you differ it in other languages, like Russian, for instance, when sex and gender are the same word as the word "floor" - "пол" (that's actually irrelevant, what's relevant is that gender and sex are translated to a single word)

Not quite when it comes to sex, it pretty much is black and white but there is a TINY sliver of grey, the amount of people who are born of indeterminate sex is minuscule.
