In my opinion it depends entirely upon the context of the situation, if it was a pre planned, malicious murder then I feel the death penalty or worse should be applied, where as if you are attacked by a knife wielding retard and you kill him in self defence then a jail term would suffice but only because he didn't use restraint when defending himself.

It's about intent.
Right, if you seek revenge on somebody and decide to kill them, that's when it becomes murder, you have pre planned it, it's a malicious act and you for example go and stab them. At that point you knew exactly what was going to happen and what you were doing, there is no excuse for that, where as killing in self defence, you could slug a guy hard in the jaw, jar his neck and break it, you never meant it, it's still a shit thing to do but i'd say it's not as bad as deliberately gutting someone.
It's all about the motive.

I don't understand the death penalty. If you kill someone in a terrible way, you don't deserve death. Lock them up in a dark cell until they rot.

I saw an ameture documentuary on TV about a prison in (Norway?) Which was essentially an island that was run by prisoners. Reform will always be more effective than letting people rot in cells or capital punishment.
