Good point. However, that doesn't remove the fact that it could still kill innocents in difficult cases.
38 innocents is 38 too many. Heck, a hundred guilty people is a hundred too many exectued. And to propose that every innocent can be caught is to be delusional. There will always be flaws. To bring your own point around and right back at ya, no system is perfect.

As for locking them up, what purpose does it serve if they're there until they die anyways? A life sentence in prison is the equivalent of a death penalty, they're not going to be released, they're going to die in jail. This is why I said if there is irrefutable proof they can't be rehabilitated and committed the crime then they should be killed, if there's is absolute proof when or why should they review the case? They know he did it, and that he's never going to be released, he's going to die for what he did by staying in jail for the rest of his life anyways, and if he can't be rehabilitated then he's not going to think about what he's done or feel guilty for it either. For these people, whether or not they die now, or die later for what they did, they're still going to die for it, and if they die now there's no chance of them escaping and re-offending.
