Yeah, modern helmets are made to protect from low calibre shots, this isn't WWII where you were better off placing a cooking pot on your head.

What if he was moving up towards this building through an open field and was caught off-guard? The decision making of "should I shoot and risk the girl's life or not?... uh oh I just got shot" probably happened within a time-frame of less than a few seconds.
