Assessment of what though? That companies/developers waste time and money on stopping cheaters online? Exploits and bugs are one thing but hacks are another. Stopping an online hack is just like cutting off an octopus' tentacle. It will just regrow it. You have to aim for the head. Kind of what Sony is doing right now.

Sony doesn't have the right to do anything with the hardware I bought and the capabilities and features it came advertised with. Sure there are a lot of fancy legal ways, rules, guidelines and millennium acts that allow them to bury people with court costs or simply make their lives miserable, but there is no right here.
The only problem I see here is just focusing on Sony. This crackdown on hacking (in the true sense of the word not some 20$ Trainer Aimbot hacking) is becoming more and more prevalent, which is quite worrisome.

Technically, they aren't stopping you doing anything with the hardware. You can do whatever you want to the hardware and they won't care as just modifying the hardware itself doesn't affect their other users. When you start messing with their software (GameOS, which you [B]do not[/B] own), they are well within their right to remove your rights to certain things. They removed OtherOS because of Geohot gaining access to the HV if I recall, which would have given him access to the software esaily enough eventually. It was a dick move to remove it, but only a minimal portion of their userbase actually used it, and most of those people wouldn't update their consoles as they didn't use it for much else.
The people who say they are fighting the good fight against Sony and their "tyranny" don't give a single fuck about OtherOS, they hopped on the bandwagon when sony started attacking developers this way, when the OtherOS hacks get released I bet almost none of these people will use it. A lot of them just use the CFW to run the small amount of applications that aren't backup managers, pirate, or just generally be a pain in the ass online. The people who actually care about OtherOS are busy working on it, trying to help where they can, not arguing with people and insulting those who disagree.

The appropriate outcome of this situation would be for Sony to realize how flawed and exploitable their anti cheat and banning system is, and remove it.

This is a slippery slope, since the PS3's are sold with the firmware/OS preinstalled.
Sure he's not allowed to duplicate and spread it, but since it's bundled with the hardware at purchase then we're reaching a iffy situation with this, with whoever owns it and the rights for updates since it's still a legit purchased OS/firmware.
One could easily ague that it's the same deal with OS on computers as with consoles, especially since consoles are reaching a point where they're almost becoming computers that's designed with games in mind.
So they're basically limiting a customer from doing things the consoles easily can, especially since ideally it should be the game publishers/developers/distributors handling the piracy & cheating/hacking issue.
And I base my post on how the laws are in Europe, don't know about the US on that point.

We only own a licence to use the OS, not to modify or redistribute it/ modifications to it. When you buy the console you buy the right to use the OS, and the hardware.
