Just because the racism in society doesn't wear a separate drinking fountain for blacks doesn't mean it no longer exists. (Unfortunately, Rand Paul would be fine with a separate drinking fountain for blacks)

I don't see it that way, a business isn't owned by the government, it's something that an individual is putting their time and money into and they should be able to do business how they please. Obviously, there should be some restrictions like you can't just dump your garbage into a river and screw up the fishing industry, but I'm not seeing how not accepting money from certain people is causing any real harm. Of course we're always going to have large corporations who won't discriminate like Wal Mart or McDonalds. I think the discrimination would be limited to "Mom & Pop shops" like Joe's Eat 'Em Up Joint.

All business owners should be afforded liberty, but only to the point where they do not start infringing on other people's liberty. Surely even Scorpious wouldn't say that companies should not be subject to rigorous and frequent health and safety inspections for the good of the public, and it isn't much of a jump from keeping the public safe to keeping the public free from discrimination. Racism still does exist and there are quite a few business owners out there who only serve minorities because they have to by law (it's a HUGE problem in Canada with white business owners and Aboriginal people - I know because I've talked to these business owners. And in a small town like this, the discrimination would be community-wide and extremely detrimental to the Aboriginal people living here), and getting rid of that law would be a step backwards. It's the same principle here. In fact the opposite is true, the ability to choose who you allow in your private residence or business is the liberty.
