If it goes through the server, then it can be eavesdropped (The clients need to agree on encryption settings to use, if that goes through the server then the server can read/change them, if they don't then there's no need to go through the server)
To defeat spying of that nature though (Where the server itself is untrusted) you need end to end encryption, encryption between the client <> server node isn't enough.

To be fair if you were [I]that[/I] paranoid about spying you would take more measures than just jumping on a random TS server and enabling encryption. Its a good point though, a lot of things people think are encrypted are pretty weak. As shown with the revelations about SSL recently.

Yeah, we're talking about spy level paranoia here, honestly the NSA/CIA/FBI/ASIO/etc. don't care about people chatting while playing games, it's just a good idea to be aware exactly how this works so you don't have either a false sense of security, or a heightened sense of fear.

The real problem here is that the Lavabit owner isn't allowed to say why his service is being shut down.

seriously though who even uses email for sensitive data or even private discussions, it's 100% newsletters and registrations for me, sprinkled with the occasional chain letter from my mom. Everybody's paranoid with some delusion that they're important enough for the government to give them the time of day, I couldn't care less if I had some dude personally dedicated to reviewing all of my spam mail and quality checking my interests on tumblr
I think email is pretty standard to know on the totem pole of privacy breeching, delete your facebook accounts if you're worried. At least don't browse other webpages with FB open- Their cookies mine data to target ad services, much like google does. God forbid they profit from actually giving people better ads instead of bombarding everyone with victoria's secret sales and class action lawsuit info regarding misothelioma
having said all that though, this is an absolute shit situation for lavabit and all of its users to be going through, and it's entirely wrong of the government to do what they're doing. Sure the guy is super wanted, but I don't see what gets accomplished by taking a wrecking ball to any bridges linked to him

What's incredibly frustrating about it is that this affects all of us, because most decent mail services are hosted in the US, and even if they aren't, the NSA apparently has the means to break in and get what they want if they have the suspicions to do so.
What about tormail?

Huh? Sure he did. His service isn't being shut down, he shut it down himself.
The clearest explanation is that a court requested that he turn over info regarding Snowden, and rather than comply he shut down the entire service.
