"YOU UNDERSTAND THAT YOU AND VALVE ARE GIVING UP THE RIGHT TO SUE IN COURT AND TO HAVE A TRIAL BEFORE A JUDGE OR JURY."
[editline]23rd December 2014[/editline]
this is pretty common practice. it won't hold up in court, obv.
This should be illegal though. Not everyone has enough experience/knowledge to know clauses like that don't hold up in court but companies still write obviously false shit to dissuade people who don't know.
It's the same with all those clauses that go around the lines of "You can't sue us, any and all claims go before a court of arbitration with an arbiter we have chosen in advance" like yeah that guy's gonna be real fuckin' neutral. Side with the company that potentially brings dozens of other cases before him, or side with the one-shot party who just wants their claim and you'll never see again?
People should never waive the right to a judge IMO, it's probably one of the most important rights in a modern society. Judges are the only real possibility people have to level the playing field between a weak and a strong party, like a consumer and a business.
I like how Watch Dogs was a broken shitfest, and somehow people looked past that and bought the next broken shitfest.
You don't get to complain when you guys buy Assassin's Creed : Victory and it's broken.
Yep, I really doubt they care. They know people will buy the next AAA game and season pass regardless.
Then people act all shocked WOW I DIDN'T THINK UBISOFT COULD DO SUCH THINGS and its like really..

I dunno about in the US, but clauses like this don't mean shit in the EU since you can't sign legal rights away, even if you want to.
This kind of shit NEVER holds up in court.
Granted, I think you are kind of a dick if you accept a free game from Ubisoft, then turn around and attempt to sue them.
But this could have all been prevented by Ubisoft not putting out an incomplete game.
I think we've found next year's Worst Company in America winner...
The fact they had to do this just explains to me that Ubisoft has fucked up and they know it.
They just keeps on digging and shooting themselves in the foot at the same time.
If you don't think you'll like the game or you hear people talking about how shit it is then how about, you know, just don't buy it? What the hell kind of world must you think you live in where you can sue the developers/publishers of a game you didn't enjoy it due to it being buggy when you voluntarily purchased it (especially this far after release when the bugs are well known).
If you're that damn concerned about enjoying a game then maybe you'd be better of waiting for a few weeks for reviews to come out before committing to purchasing it instead of throwing a hissy fit and suing? If they keep producing shitty games that are worth suing over then surely they'll destroy themselves given enough time anyway unless they learn to do a better job. And if not... then we as consumers are the ones who are at fault for being so dumb as to repeatedly buy their shitty games.

My brother actually bought Unity and i tried it, it felt like they released a beta instead of a finished product because of how bad that game was.
But i agree that it is stupid to sue a company just because of a game.
But it is even more idiotic that the company had to go out and say that a person have "waived" their right to sue when they bought said game.
Ubisoft is going in a downward spiral because they are rushing products to be released and it seems that they spend most of their bugdet on marketing instead of QA. That right there is my concern, and it includes the whole industry.
I've learned not to preorder a game just because of the hype years ago. And i do bide my time waiting on reviews and information about games i'm interested in.
Either way, we are allowed to voice our opinion regardless you like it or not.
