What is the legality of a president making the conflict in Korea hot again? I mean it wasn't officially declared as a war, but a police action? Since it was never ended, could Trump just take action since technically its been active?

I have a theory on how the refugee crisis of north korean civies will be solved. It is a gruesome one. What will happen is many will flee north to escape the conflict. The Chinese will report the civies fleeing as a north korean "troop surge" trying to invade China. Which of course the Chinese will neutralize as quickly they can.
No refugees. No Problem.

NPR summarized the strategy on the radio not too long ago, saying that it includes

I got the impression that Trump is trying diplomacy first expecting it to fail and is probably just waiting for the right time to bomb them rather then hope Plan A actually works.

If this happens there'd be literally zero point in us ever going to war with them in the first place, also China stationed military at the border specifically to provide medical assistance to any potential refugees in the event of war, they won't turn their guns on them.

The one thing I can think of is that it would fuck up North Korea's personality cult pretty hard as the Kim dynasty would most likely very suddenly go from being near-deified (or fully deified in Kim Il-Sung's case) to being corrupt, treasonous frauds that the glorious military had to save the North Korean people from.
