The Founding Fathers weren't omniscient, there's really no reason to follow their words as gospel if they're no longer appropriate

Oppressive governments are timeless. They will always come and people will always have to fight them.

There is no such thing as a "constitutional rebellion". There's just rebellion.
And no, they're not unless they're specifically formed to fight the government.
