first off, theres been large releases of fangames before which have not been shut down right away so its got some fair use wiggle room but really they probably didnt see 1.5 million downloads coming

But yeah, it sucks that it was taken down especially after all the hard work that was put into it.

If anything, quality fangames like this should put these kinds of "fan-indies" (I don't know how else to classify these kinds of developers) on the map for studios to snap up. Have them work for you to make something interesting.
Or alternatively, "fan-indies" could think about forming their own little studios, and use their prior experience to make something original. Like how this one group of fan-indies was making a Sonic fangame, and ended up transforming it into its own thing by the name of Freedom Planet.

I agree with the rest of this post, but this is a game that's full of nuclear fallout and radiation poisoning and [I]lets the player use it against other Pokémon[/I].
There's no way Nintendo is going to touch this with a ten foot pole (unless there's a pike on the end, that is).

Warez implies illegally shared software, which this is because it has no legal right to exist. That rule can be enforced arbitrarily, however.

They are free to sell official emulators, but people are also free to write their own.

Not necessarily, fair use exists, it does not cover uranium as far as I know though.
Why artwork is ok: it does not compete with Nintendo's product line. A game does. Even if it's free.
