I never said that because people aren't trained to handle the situation means that they should be able to kill somebody. He may however temporarily arrest criminals (at least in Germany every body has the right to arrest criminals while they committing the crime). Arresting however does not mean making somebody mentally disabled. What would you think if you stole a chewing gum, a police officer comes along, takes his baton and hits you untill you're half dead, sitting the rest of your live in a wheelchair and the court says "well you committed a crime, it's your own fault."
