If it worked, it would deliver fair punishments focused around the welfare of all parties. Sure a jail sentance is a punishment and a deterrant, but it also comes with the chance of redemption and education that will allow for you to become a productive member of society afterwards. The whole definition of just is fairness, and a system that abuses human rights and can give out sentances without parole is not just, as it offers no chance for reform, which is the whole point of a modern, effective justice system, as is seen in countries with controlled crime rates such as Sweden or Norway, whilst countries that attempt to deter through extreme brutality and turning a blind eye to rape and assault such as the US prisons are not fair, therefore they are not just, which means the system is broken. Oh yeah, and a significant racist bias in courts is also not fair, ergo not just.
