Why would Microsoft have to refund them? It's not Microsoft's fault the father didn't check his bank statements/check up on his kid. It's the kid's and father's fault.
They should refund some of his money for publicity then ban his account for negative publicity.
Reminds me back a while ago I used my brother's card to make a one-month payment of £5 for some Xbox LIVE, it signed him up for monthly payments and neither of us realised, so I payed him the ~£100 that it had taken over the course of about two years and cancelled it. It's fucking shit, nowhere did it say "Sign me up for a payment of £5 a month!" or whatever. Conners.

I remember something like this. Back when Halo 3 was just released, I was hanging out with some of my stoner friends (I don't smoke myself) and we were playing around on forge. All of a sudden Justin who is completely baked says "WHOA GUYS WAIT STOP I THINK THIS SHIT COSTS REAL MONEY" and then everyone starts buying flamethrowers for 35 bucks apiece and Justin is freaking out because he doesn't know how he'll tell his parents, when the sober ones finally tell him that it's not real money and that idea is preposterous.

Blame it on the big corporation that's currently holding your money, and you stand a slightly better chance of getting a refund (if partial) as well as exiting with your dignity intact.
Flag the kid's account as a cheater, and work out some deal with the dad about the money (refund if possible, otherwise i have no clue).
